HKMAAL
published the updated Hong Kong Mediation Code (the "Updated Code”)
in April 2026. I am pleased to note the many positive responses from mediators
and stakeholders. Such positive responses have reflected the broad support for
the continued development and refinement of professional mediation standards.
HKMAAL encourages parties, mediators, and
mediation organisations to adopt the Updated Code in their mediation agreements
and practices. We will step up our promotional efforts to enhance awareness and
understanding of the Updated Code across the mediation community and the wider
public. In furtherance of this objective, I contributed an article in Chinese
to Ming Pao outlining the key features and practical significance of the
Updated Code, which was published on 13 May 2026 (please see HERE). HKMAAL
will also co-organise a seminar with the Financial Dispute Resolution Centre (FDRC)
on 7 July 2026. (please see HERE).
The Chinese versions of both the Updated Code
and the HKMAAL "Agreement to Mediate” are currently being finalised and will be
published on the HKMAAL website very soon.
I take this opportunity to emphasise that,
unless otherwise announced by HKMAAL, the Updated Code will not affect the current
conduct and expectations of the HKMAAL Mediation Assessments (commonly known as
"Stage 2 Assessments”) for the purposes of General Mediator Accreditation. The
existing HKMAAL Assessment Form, Core Competencies, and Mediation Process Model
applicable to Stage 2 Assessments remain unchanged.
As the Chairman of HKMAAL, I attended
the following events this month:-
a) Mediation Week 2026;
b) Global Mediation Summit;
c) Rule of Law Drama Day;
d) A consultation session
held at the Legislative Council; and
e) A consultation session
held at the Department of Justice ("DoJ”).
In relation to the aforesaid consultation sessions, HKMAAL has submitted
written submissions to the Legislative Council and the DoJ concerning Hong
Kong’s proactive alignment with the National 15th Five-Year Plan Outline, as
well as the formulation of Hong Kong’s first-ever local Five-Year Plan.
On 26 May 2026, I visited the International Organization for Mediation ("IOMed”)
and enjoyed a dialogue with the Secretariat of the IOMed. HKMAAL looks forward to working with the IOMed
and making further contributions to the promotion of mediation in Hong Kong,
the Chinese Mainland and among the member states of IOMed.
